1. About this website

Please read these terms before using the site. They apply to website use to the extent a binding agreement is formed under applicable law. If you do not accept the permitted-use conditions, please discontinue use. Nothing here requires payment, creates a service engagement or waives a nonwaivable legal right merely because you browse the site.

2. Inquiries and service agreements

An inquiry, email, telephone call, website description or request for information is not a confirmed quotation, equipment reservation, vessel booking, charter fixture or acceptance of an engagement. Rates, specifications, availability, services, responsibilities and timing must be confirmed through the applicable written agreement and authorized representatives.

A signed retainer agreement, service authorization, rental agreement or Charter Party governs the services it covers and prevails over inconsistent website language. Any retainer, fee, cancellation right, delivery commitment or refund policy is determined by that agreement. Website references to a $50,000 retainer are general descriptions of the charter engagement process and do not themselves create a payment obligation.

Affiliated companies remain separate legal entities. A reference to an affiliate does not make it a guarantor or contracting service provider unless it expressly undertakes that role in writing.

3. Petroleum transactions and our role

Total Tank Leasing and its affiliates provide logistics services and are not sellers of petroleum products under the services described on this website. We do not represent that a particular product exists, is available, has valid title or meets stated specifications, or that a petroleum trade is authentic, financeable or capable of completion.

Petroleum transactions involve significant commercial risks, including fraud, false documentation, counterparty default, financing problems, sanctions and delays. 4. Q88 and charter information

A Q88 vessel questionnaire is informational. Receiving, paying for, reviewing or sharing a Q88 does not confirm vessel availability, reserve capacity, establish a charter fixture or authenticate a petroleum transaction. Vessel availability remains subject to owner or operator approval, compliance review, agreed charter terms and authorized written confirmation.

Company documents and endorsements may be used only for their authorized purpose, subject to their terms and any signed agreement. You must not alter, misrepresent, sell, publish or circulate restricted documents without authorization, or use our name to imply approval of a transaction.

5. Compliance and lawful use

You must use the website lawfully and provide accurate information when making an inquiry. Do not impersonate another person, submit false documents, infringe intellectual-property or privacy rights, introduce malicious code, attempt unauthorized access, or interfere with the website’s operation.

Engagements may require sanctions and other applicable compliance review. We may decline, suspend or discontinue affected activities when information is incomplete or a reasonable legal, sanctions, safety or authenticity concern arises. Website content and routine screening are not a government approval or a guarantee that wrongdoing will be detected. Each party retains its own legal obligations.

9. Governing law and disputes

New Jersey law governs these website terms, without its conflict-of-laws rules, subject to controlling federal law and any mandatory protections of applicable law. To the extent enforceably agreed and legally permitted, disputes about these website terms will be brought in New Jersey state courts or the United States District Court for the District of New Jersey where federal subject-matter jurisdiction exists.

This clause does not change an expressly agreed dispute procedure in a separate service agreement, override mandatory jurisdiction or venue rights, or impose arbitration or a class-action waiver.
